1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of deckdiver.app ("the Service"), operated by the provider identified in our Legal Notice.

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Service Description

deckdiver.app is a search platform for Magic: The Gathering Commander deck lists. We provide tools to discover, filter, and analyze community-sourced deck configurations. The Service offers both free and paid subscription tiers with varying feature access.

Free Tier: Basic search functionality with access to all deck data.

Paid Tiers: Extended features such as unlimited searches, advanced filters, and additional functionality. Paid tiers enhance the user experience but do not restrict access to underlying deck data.

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• One person may not maintain multiple accounts
• You must be at least 16 years old to create an account

4. Subscriptions and Payment

4.1 Pricing

All prices displayed on deckdiver.app include applicable value-added tax (VAT) and are stated in Euros (EUR). The current subscription prices are shown on our subscription page.

4.2 Billing

• Subscriptions are billed monthly in advance
• Payment is processed securely through Stripe
• Subscriptions automatically renew at the end of each billing period unless cancelled

4.3 Price Changes

We reserve the right to change subscription prices. Active subscribers will be notified at least 30 days before any price change takes effect. You may cancel before the new price applies.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation options:

• Through your account settings when logged in
• Via your personal account page or the cancellation link at the bottom of the web site (no login required)
• By contacting us at the email in our Legal Notice

After cancellation, you retain access to paid features until the end of your current billing period.

5. Right of Withdrawal (Widerrufsrecht)

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

If you requested that the services begin during the withdrawal period, you shall pay us an amount proportional to what has been provided until you communicated your withdrawal.

Waiver for Immediate Service

During checkout, you may consent to immediate service commencement and acknowledge that this waives your right of withdrawal once the service has been fully provided. This consent is optional and clearly indicated during the purchase process.

6. Acceptable Use

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Use automated tools to scrape or harvest data beyond normal API usage
• Circumvent rate limits or access restrictions
• Submit false, misleading, or fraudulent information
• Resell or redistribute the service without authorization

7. Intellectual Property

Deck lists and ratings are sourced from publicly available community data. Users should verify card legality and tournament compliance independently.

8. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information in compliance with GDPR.

9. Service Availability

• We aim to maintain high availability but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We reserve the right to modify or discontinue features with reasonable notice

10. Limitation of Liability

To the extent permitted by applicable law:

• We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service
• Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim

11. Termination

We may terminate or suspend your account and access to the Service if you violate these Terms or engage in conduct harmful to other users, us, or third parties. We will provide notice and an opportunity to remedy non-severe violations where reasonable.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (e.g., limitation of liability, governing law) will remain in effect.

12. Changes to Terms

We may modify these Terms from time to time. For material changes, we will notify you via email or a prominent notice on the Service at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance.

If you do not agree to the modified Terms, you may cancel your subscription before the changes take effect.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions.

For consumers residing in the EU, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence.

Any disputes shall be subject to the jurisdiction of the competent courts in Germany, unless you are a consumer entitled to bring proceedings in your country of residence.
